E-commerce Terms of Sale (Distance Sales Contract & Pre-Information)

These Terms apply to purchases made on acmeenglish.com (including coin packages paid via iyzico). They are prepared with reference to Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts under Turkish law. By completing a purchase, you acknowledge that you have read and accept these Terms. Related documents: Privacy Policy .

1. Seller Identity

The seller (“Seller”, “we”, “us”) of the digital products and services described in these Terms is:

Activities include online English education, exam preparation (including IELTS and TOEFL-focused practice), private tutoring / teacher matching, lesson booking, learning resources, and related customer support.

2. Subject and Scope

These Terms set out the rights and obligations of the Seller and the buyer (“Buyer”, “you”) for distance sales of digital products and services offered on the website and member areas of acmeenglish.com, in particular the purchase of coin packages used to book and take live online lessons and related paid features.

These Terms form a distance sales contract once your payment is successfully authorised and the order is confirmed. Pre-contract information shown at checkout (package name, coin amount, price, payment method) is an integral part of the contract.

3. Definitions

  • Buyer: A natural or legal person who purchases a product or service through the Platform.
  • Platform / Website: acmeenglish.com and its member portals (including the student dashboard).
  • Coins: Digital credits recorded on your student account and used to book lessons or access paid features as described on the Platform.
  • Coin package: A paid bundle of Coins (and any promotional bonus Coins) offered for sale at the price shown at the time of purchase.
  • Digital service / digital content: Coins and related online education services delivered electronically, without a physical shipment.
  • Payment service provider: Currently iyzico (and card schemes such as Visa / Mastercard processed via iyzico).

4. Products and Services Offered

Through the student dashboard (and any other purchase screens we enable), you may buy coin packages. The exact coin amounts, bonus coins (if any), package labels, and prices are those displayed on the purchase screen at the time you confirm payment.

Coins are not cash, are not legal tender, and cannot be transferred to another person or cashed out except where a refund is required by law or expressly agreed by the Seller under these Terms. Coins have no value outside the Platform’s services.

Live lessons are scheduled by you using Coins according to availability rules, lesson duration, and booking policies shown in the student area. Lesson content is educational support and does not guarantee exam results, admission, or any particular score.

5. Prices and Taxes

  • All prices are shown on the Platform before you confirm payment (including the currency displayed, e.g. USD or TRY, as configured).
  • Unless otherwise stated, displayed prices are the final amounts payable for the selected package at checkout.
  • Any applicable taxes, bank / card fees, or foreign exchange charges imposed by your bank or card issuer are your responsibility and may appear on your card statement separately.
  • The Seller may change package prices at any time; changes do not affect orders already paid and confirmed.

6. Order Process and Formation of Contract

  1. You must have a valid student account and be logged in (unless a different purchase flow is offered).
  2. Select a coin package and proceed to Secure Checkout.
  3. Review the order summary (package, coins, any bonus, total price).
  4. Pay via the integrated payment method (iyzico). Card data is entered on iyzico’s secure environment; the Seller does not store full card numbers or CVV.
  5. Upon successful authorisation, the contract is formed and Coins are credited to your account as described in Section 8.
  6. If payment fails, is declined, or is cancelled, no contract is formed and Coins are not added.

You are responsible for ensuring that payment details and account information you provide are accurate and that you are authorised to use the selected payment method.

7. Payment

Payments are processed by iyzico (or another licensed payment institution we may designate and display at checkout). Accepted card brands and payment options are those shown on the checkout screen.

  • The Seller does not store full primary account numbers (PAN) or CVV on its servers.
  • 3-D Secure or similar authentication may be required by your bank or iyzico.
  • Suspicious or fraudulent transactions may be declined, delayed, or reversed. We may request additional verification.
  • In case of chargebacks or disputed payments, we may suspend related Coins or account access while the dispute is reviewed, to the extent permitted by law.

8. Performance / Delivery (Digital)

Because Coins and related services are digital:

  • Delivery method: Electronic credit to your student account on the Platform.
  • Delivery time: Ordinarily immediately after successful payment confirmation. In rare cases (technical delay, fraud review, payment pending), crediting may take longer; contact us if Coins do not appear within a reasonable time.
  • Proof of purchase: Your account balance, transaction history (where available), and payment confirmation from iyzico / your bank serve as evidence of the transaction.
  • There is no physical shipment and no shipping cost.

Performance is deemed begun when Coins are successfully added to your account (and, where applicable, when you use Coins to book a lesson).

9. Right of Withdrawal (Consumers)

Under the Regulation on Distance Contracts, consumers generally have a 14-day right to withdraw from a distance contract without giving any reason and without paying a penalty.

Important exception for digital content and digital services: The right of withdrawal does not apply (or is lost) where:

  • the contract is for the supply of digital content not supplied on a tangible medium, or for digital services; and
  • performance has begun with the consumer’s express prior consent; and
  • the consumer has acknowledged that they will lose the right of withdrawal once performance begins,

in accordance with applicable Turkish consumer legislation.

By completing Secure Checkout and confirming payment for a coin package, you request immediate performance (crediting of Coins) and acknowledge that, once Coins are credited to your account, you lose the right of withdrawal for that purchase to the extent permitted by law.

If, under mandatory law, a withdrawal right still applies to a specific order (for example where Coins were never delivered due to a technical failure entirely attributable to the Seller), you may notify us within the statutory period using the contact details in Section 18. We will process the request in line with consumer law.

Business / commercial buyers (non-consumers) are not entitled to consumer withdrawal rights unless mandatory law provides otherwise.

10. Refunds, Cancellations, and Lesson Bookings

10.1 Coin packages

  • After Coins are successfully credited, purchases are generally non-refundable, subject to mandatory consumer rights and the exceptions below.
  • If payment is taken but Coins are not delivered due to a proven system error on our side, we will either credit the Coins or refund the payment amount, at our option and as required by law.
  • Duplicate charges caused by a clear technical error will be corrected (refund or credit) after verification.

10.2 Lessons booked with Coins

  • Booking, cancellation, and rescheduling rules (including any time limits before the lesson start and coin return policies) are those shown in the student dashboard or booking interface at the time of booking.
  • If a lesson is cancelled by the Seller or tutor for reasons not attributable to the Buyer, Coins used for that lesson will normally be returned to your account, or a makeup option offered, as indicated in the platform rules.
  • If you miss a lesson without cancelling within the allowed window, Coins may be forfeited as stated in the booking rules.

10.3 Refund method

Where a monetary refund is due, it is typically returned to the original payment method via iyzico within the timeframes set by the payment provider and your bank. Coin-only adjustments (re-credit) appear on your account balance.

11. Buyer Obligations

  • Provide accurate identity and contact information and keep your login credentials secure.
  • Use the Platform and purchased services only for lawful educational purposes.
  • Not resell, transfer, or commercially exploit Coins without our written consent.
  • Not attempt to manipulate balances, payments, or booking systems.
  • Treat tutors and staff respectfully; abusive conduct may lead to account suspension without refund of unused Coins, where permitted by law.
  • Ensure a suitable device, internet connection, and quiet environment for live lessons.

12. Seller Obligations

  • Provide the digital products/services as described at the time of purchase, subject to reasonable technical maintenance.
  • Process payments through a licensed payment partner and not store full card secrets on Seller servers.
  • Respond to support and complaint requests within a reasonable time.
  • Handle personal data in accordance with our Privacy Policy and KVKK.

We may interrupt services for maintenance, security, force majeure, or legal compliance. Planned or emergency downtime does not by itself entitle you to a refund of unused Coins, except where mandatory law requires otherwise or we choose to offer goodwill compensation.

13. Complaints and Consumer Applications

For order, payment, coin, or lesson issues, please contact us first using the details in Section 18 so we can investigate promptly.

Consumers in Türkiye may also submit applications to the competent District / Provincial Consumer Arbitration Committee or consumer courts under Law No. 6502, within the monetary and procedural limits applicable at the time of the dispute. You may also use other remedies available under applicable law.

14. Personal Data

Identity, contact, account, and payment-related data (to the extent received by the Seller) are processed for concluding and performing the distance sales contract, fraud prevention, accounting, and legal obligations. Details are set out in our Privacy Policy. Card data is processed by iyzico under its own security and privacy terms.

15. Force Majeure

Neither party is liable for failure or delay caused by events beyond reasonable control, including but not limited to natural disasters, war, terrorism, epidemic, government action, widespread internet or power outages, payment network failures, or strikes. Obligations are suspended for the duration of the event. If force majeure continues for an extended period making performance impossible, either party may terminate the affected order to the extent permitted by law, without prejudice to mandatory consumer rights.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Türkiye. For consumer disputes, mandatory venues and consumer protection rules under Turkish law apply. For non-consumer disputes, İstanbul (Anadolu) courts and enforcement offices shall have jurisdiction, unless mandatory law provides otherwise.

The English and Turkish versions of this page are provided for convenience. In case of conflict for contracts concluded with consumers in Türkiye, the Turkish text shall prevail.

17. Changes to These Terms

We may update these Terms to reflect product, payment, or legal changes. The “Last updated” date at the top of this page will be revised. Material changes apply to purchases made after publication. Orders already completed remain subject to the Terms in force at the time of purchase, except where a change is required by law.
