Terms of Service

These Terms of Service (“Terms”) govern your access to and use of acmeenglish.com, our member portals, tests, courses, booking tools, and related online education services (collectively, the “Services”) operated by Online Exam Training Yabancı Dil Eğitim Hizmetleri Ltd. Şti. under the trademark Acme English. By creating an account, browsing the site, booking a lesson, or purchasing coins, you agree to these Terms. 1. Who We Are

We offer online English language training, exam preparation (including IELTS and TOEFL-oriented practice and materials), private tutoring, lesson booking, diagnostic and practice tests, learning resources, and related support.

2. Acceptance of These Terms

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

If you use the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

3. Eligibility

  • You must provide accurate information when registering and keep it up to date.
  • You must be legally able to enter into a binding contract under applicable law, or use the Services under a parent/guardian who accepts these Terms on your behalf.
  • Teachers and other staff accounts are issued or approved by us and may be subject to separate agreements or internal policies.
  • We may refuse, suspend, or limit registration where we reasonably believe these Terms may be violated or fraud risk exists.

4. Accounts and Security

  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • Notify us promptly at Contact form if you suspect unauthorised access.
  • Do not share accounts. One natural person should control one student account unless we expressly allow otherwise.
  • We may require re-authentication, password changes, or additional verification for security.
  • Account profiles (name, photo, goals, contact details you provide) may be used to operate tutoring, booking, and support features as described in the Privacy Policy.

5. Services Overview

Depending on your role and purchases, the Services may include:

  • Public website content, course descriptions, tutor listings, and resources;
  • Student and teacher member dashboards;
  • Diagnostic and practice tests;
  • Coin packages and balance management;
  • Lesson booking against teacher availability;
  • Live video lessons via integrated third-party video tools;
  • Messaging or support channels we enable.

We may add, change, or discontinue features. Material changes that affect paid digital products are also addressed in the E-commerce Terms of Sale.

6. Coins (Digital Credits)

  • Coins are digital credits recorded on a student account and used to book lessons or access paid features as shown on the Platform.
  • Coins are not cash, not legal tender, and have no value outside the Services except where a refund is required by law or expressly granted by us.
  • Coins are non-transferable between accounts and may not be resold or commercially exploited without our written consent.
  • Purchase, delivery, withdrawal, and refund rules for coin packages are set out in the E-commerce Terms of Sale.
  • We may adjust balances to correct proven technical errors, fraud, or unauthorised transactions.

7. Bookings and Live Lessons

7.1 Booking

  • Students book lessons based on teacher availability published on the Platform.
  • Lesson duration, coin cost, cancellation windows, and “Enter Class” timing rules are those displayed in the student/teacher interfaces at the relevant time.
  • A booking is confirmed when the system accepts it and deducts the applicable Coins (unless a different confirmation flow is shown).

7.2 Attendance and cancellation

  • Please join on time using the provided class entry method.
  • Cancellations or reschedules must follow the time limits shown in the booking UI. Late cancellation or no-show may result in forfeiture of Coins as stated there.
  • If we or a teacher cancel for reasons not attributable to you, Coins for that lesson are normally returned, or a makeup option is offered, per platform rules.

7.3 Conduct in class

  • Live lessons are for educational purposes. Recording is only allowed if we or the other party expressly permit it and applicable law is respected.
  • Harassment, hate speech, sexual content involving minors, threats, or illegal activity in sessions is strictly prohibited and may lead to immediate termination of access.
  • You are responsible for a suitable device, internet connection, and environment for video lessons.

8. Teachers, Materials, and Educational Content

  • Teachers are professionals or contractors providing language instruction through the Platform. Their profiles, ratings, and availability are informational; individual teaching styles may vary.
  • Course materials, test items, lesson plans, and media on the Platform are for personal educational use by registered users only, unless we state otherwise.
  • You may not copy, redistribute, publish, or sell our materials or test content without written permission.
  • Diagnostic and practice tests are learning tools. They are not official exam scores and are not affiliated with official IELTS, TOEFL, or other exam boards unless explicitly stated.

9. Acceptable Use

You agree not to:

  • Violate any applicable law or third-party rights;
  • Use the Services for spam, phishing, malware, scraping beyond normal browsing, or automated abuse;
  • Attempt to gain unauthorised access to systems, other accounts, or non-public data;
  • Manipulate coin balances, bookings, payments, or ratings dishonestly;
  • Impersonate another person or misrepresent your affiliation;
  • Upload or transmit content that is unlawful, defamatory, obscene, or infringing;
  • Interfere with the security or proper working of the Services;
  • Use the Services to provide competing commercial tutoring marketplaces using our data or branding without consent.

We may investigate violations and cooperate with law enforcement where required.

10. Intellectual Property

The Platform, branding (including the trademark “Acme English” and related marks owned by Online Exam Training Yabancı Dil Eğitim Hizmetleri Ltd. Şti.), software, design, text, graphics, videos, test banks, and other content are owned by us or our licensors and are protected by intellectual property laws. Except for the limited right to use the Services as permitted under these Terms, no licence is granted.

If you submit feedback, suggestions, or reviews, you grant us a non-exclusive, worldwide, royalty-free licence to use them to improve and promote the Services, without obligation to you.

11. Third-Party Services

The Services may integrate or link to third parties, including without limitation:

  • Payment processing (e.g. iyzico) — subject to that provider’s terms and security standards;
  • Video / classroom tools (e.g. Whereby or similar) — for live lessons;
  • Analytics, captcha, hosting, or messaging tools we enable for security and operations.

We are not responsible for third-party websites or services beyond our reasonable control. Your use of third-party tools may be subject to their own terms and privacy notices.

12. Payments and Purchases

Paid purchases (including coin packages) are governed by these Terms and the E-commerce Terms of Sale, which include order process, delivery of digital credits, withdrawal rights for consumers, refunds, and payment security.

Prices, package contents, and accepted payment methods are those shown at checkout at the time of purchase.

13. No Exam or Outcome Guarantees

We provide educational support, practice, and tutoring. We do not guarantee:

  • Any particular exam score, band, or result;
  • Admission to a school, university, or programme;
  • Visa, immigration, licensing, or employment outcomes;
  • That free or diagnostic tests match official exam difficulty in every respect.

Official exams (IELTS, TOEFL, etc.) are administered by their respective organisations under their rules. “IELTS”, “TOEFL”, and similar names, if used on our site, refer to exam preparation context and do not imply ownership or official endorsement unless we expressly state a partnership.

14. Availability and Changes to the Services

  • We aim for reliable availability but do not warrant uninterrupted or error-free operation.
  • Maintenance, security updates, force majeure, or third-party outages may cause downtime.
  • We may modify features, teacher rosters, test content, or UI without prior notice, except where notice is required by law or the E-commerce Terms of Sale for paid digital products already purchased.

15. Disclaimer and Limitation of Liability

To the fullest extent permitted by applicable law:

  • The Services are provided on an “as is” and “as available” basis.
  • We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, except where mandatory law prohibits such disclaimer.
  • We are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the Services.
  • Our aggregate liability arising out of or related to the Services or these Terms shall not exceed the greater of (a) the amounts you paid us for the specific purchase giving rise to the claim in the twelve (12) months before the claim, or (b) one hundred US dollars (USD 100) or equivalent — except where mandatory consumer law requires a higher or different standard.

Nothing in these Terms excludes or limits liability that cannot be excluded under Turkish mandatory law (including liability for death or personal injury caused by negligence where such exclusion is void, or liability for fraud).

16. Indemnity

You agree to defend, indemnify, and hold harmless Online Exam Training Yabancı Dil Eğitim Hizmetleri Ltd. Şti. (and its officers, employees, and agents) from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Services, violation of these Terms, or infringement of third-party rights — to the extent permitted by law and except where caused by our wilful misconduct or gross negligence.

17. Suspension and Termination

  • You may stop using the Services at any time. You may request account closure by contacting us; residual legal retention obligations may apply (see Privacy Policy).
  • We may suspend or terminate access, without prejudice to other remedies, if you materially breach these Terms, engage in fraud or abuse, create safety risks, or if required by law.
  • Upon termination for serious misconduct, unused Coins may be forfeited to the extent permitted by law and the E-commerce Terms of Sale.
  • Provisions that by nature should survive (intellectual property, liability limits, indemnity, governing law) survive termination.

18. Privacy

Processing of personal data is described in our Privacy Policy, prepared with reference to KVKK (Law No. 6698) and related rules. By using the Services you acknowledge that notice. Where consent is legally required for a specific processing activity, we will request it separately.

19. Children and Minors

Educational Services may be used by younger learners under parent or guardian supervision. Where the user is a minor under applicable law, account creation and payment should be performed by a parent or legal guardian who accepts these Terms. We do not knowingly market in a manner inconsistent with applicable child-protection rules.

20. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page will change. Material updates may also be announced on the website or by e-mail where appropriate. Continued use of the Services after an update constitutes acceptance of the revised Terms to the extent permitted by law. If you do not agree, stop using the Services and contact us regarding your account.

21. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Türkiye. Consumers retain rights under mandatory consumer protection law (including Law No. 6502). For non-consumer disputes, İstanbul (Anadolu) courts and enforcement offices shall have jurisdiction, unless mandatory law provides otherwise.

English and Turkish versions are provided for convenience. For contracts with consumers in Türkiye, in case of conflict the Turkish text prevails.
